For parents, the toughest part about divorce often revolves around their children. How do you ensure they're well-cared for and still get to spend quality time with both mum and dad? Let’s break down Child Arrangements.

Child Arrangements: Where will the children live?

This is the big question on many parents' minds. All arrangements relating to children fall under the remit of a Child Arrangements Order. This is then split into two categories, a ‘live with’ order and a ‘spends time with’ order. Sometimes, there can be an order stating that the children ‘live with’ both parents, known as shared care. if this is the case, the order will stipulate which days the children ‘live with’ each parent.

Remember, it's all about what's best for the children and for the Court, the children’s well-being is paramount.

Quality time matters

Even if the children ‘live with’ parent, they still usually spend time with the other parent. The starting point for the court is that every child has a right to spend time with both parents, unless they are at risk of harm from doing so. Usually a Child Arrangements Order will set out the days and times the children are to spend time with the parent they do not live with. This then makes it clear which parent is responsible for the care of the children at any one time and also ensure a proper routine is in place for the children.

Child Maintenance

The family courts do not usually involve themselves in the issue of child maintenance as this is dealt with via the Child Maintenance Service. The amount of child maintenance paid by one parent to the other will depend on how many nights per year the children are with the paying parent and also the paying parent’s income. The Child Maintenance Service can assist in calculating the right amount to be paid if you cannot agree.

A Few Tips:

  • Keep Talking: Open lines of communication. It can be challenging, but always keep the children’s best interests at heart.
  • Stay Flexible: Plans might need adjusting. Being a bit flexible can help smoothen the process.
