It is essential that you have legal advice before signing either of these types of agreement, even if you have agreed the contents.

Whilst it may not be nice to think about your marriage failing before its even begun, its important to ensure you protect your assets, particularly if you have significant assets prior to getting married.

A prenuptial agreement allows couples who are planning to get married to set out what would happen to their assets in the event they were to separate in the future. A postnuptial agreement is the same except it is entered into after you are married. Whilst neither agreement is currently legally binding under current law, there have been recent cases which show the court can take a pre or post nuptial agreement into account when deciding how assets should be divided. It is essential that you have legal advice before signing either of these types of agreement, even if you have agreed the contents.
